Rape Charges in Oklahoma
In Oklahoma, rape is defined in accordance with Oklahoma Statutes § 21-1111. This crime is classified as a felony, with first- and second-degree charges.
First-degree rape involves acts of force, violence, threats, use of drugs to incapacitate a victim, or targeting victims who are mentally incapacitated, unconscious, or under age 14 by an adult over 18. Spousal rape is considered a form of first-degree rape.
Second-degree rape encompasses all forms of rape that fall outside of the criteria for first-degree rape. Examples of second-degree rape can include consensual sex between a minor aged 14 or 15 and an adult perpetrator, sexual intercourse in which the perpetrator had a position of authority over the victim, and rape by instrumentation.
Penalties If You Are Convicted of Rape in Oklahoma
Based on Oklahoma Statutes § 21-1115v2, if you are convicted of first-degree rape, you are subject to a minimum of five years in prison to a maximum of life imprisonment without parole.
If you are convicted of second-degree rape, you face one to 15 years in prison. Per Oklahoma Statutes § 21-13.1, second-degree rape is an “85% crime.” As such, you must serve at least 85% of your prison sentence before you are eligible for parole consideration or earn any credits that would reduce the length of your sentence.
A first- or second-degree rape conviction will require mandatory lifetime registration as a sex offender under the Oklahoma Sex Offender Registry Act (SORA).
