The Basics Of Oklahoma Divorce Proceedings

There are two general paths that a divorce can take. If both parties agree on all matters related to the divorce, the process is known as an uncontested divorce. An uncontested divorce is typically quicker and less expensive than the alternative. If, however, the parties cannot agree on all elements of the divorce, they will need to follow the path of a contested divorce.

An Oklahoma divorce starts with one party filing a Petition for Divorce in the county in which they or their spouse live. Once the petition has been served on the other party, an automatic injunction is put in place. This injunction serves to protect the financial interests of both parties, and it essentially puts a freeze on all marital assets except for normal, day-to-day expenses.

At this time, it is possible that some temporary orders may be issued. These temporary orders may direct how certain issues will be handled while the divorce proceedings are ongoing. The orders may involve temporary child custody, spousal support, possession of the marital home, and other issues.

Discovery regarding contested issues usually takes place next. Discovery may include written interrogatories, bank records, financial statements, depositions, or other evidence. Once discovery is complete, the parties will typically attempt to negotiate and reach a settlement on all outstanding issues. In some cases, the court may even order mediation in an attempt to reach an agreement and avoid a trial.

If an agreement cannot be reached, a judge will hear the case and make a final decision on any outstanding issues. The final divorce decree will be signed by the judge and should cover all issues, including child custody, visitation, child support, spousal support, property division, and others. As soon as the divorce decree is signed by the judge, the marriage is ended. However, Oklahoma law prohibits either party from remarrying (except to each other) for at least six months after the decree is entered (2023 Oklahoma Statutes §43-123).
